Terms Acceptance

By accessing, browsing, or otherwise utilizing the website located at graviracasino.us.com (hereinafter referred to as the "Website"), operated by Horizonix Corp N.V. (hereinafter referred to as the "Company"), the user (hereinafter referred to as "User" or "You") is deemed to have read, understood, and unconditionally accepted all terms, conditions, provisions, and notices contained within this User Agreement (hereinafter referred to as the "Agreement"). This Agreement constitutes a legally binding contractual instrument between the User and the Company. Access to or use of the Website shall be construed as express acceptance of all obligations, restrictions, and provisions set forth herein. If any provision of this Agreement is found to be unacceptable or incompatible with applicable law, the User is required to immediately discontinue all use of the Website. The Company reserves the right to amend, modify, or revise this Agreement at any time without prior notice. Continued use of the Website following the publication of any such amendments shall be deemed to constitute acceptance of the revised terms. It is the sole responsibility of the User to periodically review this Agreement for any modifications. This Agreement is entered into between the User and Horizonix Corp N.V., a company duly incorporated and operating under the laws of Curaçao, holding a valid gaming license issued by the Curaçao Gaming Authority under license number OGL/2024/1944/1124. No waiver of any provision of this Agreement shall be construed as a continuing waiver of that or any other provision. The contractual obligations arising from this Agreement shall be enforceable to the fullest extent permitted by applicable law.

Use of Website

The Website and all of its content, features, and functionalities are made available exclusively for lawful purposes and in strict accordance with the terms set forth in this Agreement. Use of the Website is permitted solely for personal, non-commercial purposes unless express written authorization has been obtained from the Company. The following activities are expressly prohibited and shall constitute a material breach of this Agreement: unauthorized reproduction, distribution, transmission, modification, or creation of derivative works based upon any content made available through the Website; use of automated systems, including but not limited to robots, scrapers, data mining tools, or similar mechanisms to access, retrieve, or index any portion of the Website without the express written consent of the Company; any attempt to gain unauthorized access to the Website's systems, servers, networks, or databases; the introduction of malicious code, viruses, trojans, worms, or any other technologically harmful material into the Website's infrastructure; engaging in any conduct that interferes with, disrupts, or imposes an unreasonable burden upon the Website's servers or associated networks; circumvention of any security measures, access controls, or authentication protocols implemented by the Company; use of the Website in any manner that violates applicable local, national, or international laws or regulations; impersonation of any individual, entity, or organization, or misrepresentation of affiliation with any person or entity; collection, harvesting, or compilation of personal data relating to other users without their explicit consent; transmission of unsolicited commercial communications or spam through or in connection with the Website. The Company reserves the right, at its sole discretion, to suspend, restrict, or permanently terminate access to the Website for any User who is found to have engaged in any prohibited activity. Such action may be taken without prior notice and without liability to the User. The Company further reserves the right to cooperate with law enforcement authorities in the investigation of any conduct that may constitute a criminal offense or give rise to civil liability.

All content published, displayed, or otherwise made available through the Website, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, software, and the overall compilation and arrangement of such content (collectively referred to as the "Content"), is the exclusive intellectual property of Horizonix Corp N.V. or its respective licensors and is protected by applicable copyright, trademark, trade dress, patent, and other intellectual property laws and international treaties. The Company's trade name, trademarks, service marks, and logos are registered or unregistered proprietary marks of Horizonix Corp N.V. and may not be used in connection with any product, service, or activity without prior written authorization from the Company. No license, right, title, or interest in or to the Content or any part thereof is transferred to the User by virtue of access to or use of the Website. The User is granted a limited, non-exclusive, non-transferable, revocable license to access and use the Website and its Content solely for personal, non-commercial purposes in accordance with this Agreement. Any reproduction, redistribution, republication, modification, adaptation, public display, public performance, or commercial exploitation of the Content without the express written consent of the Company is strictly prohibited and shall give rise to civil and criminal liability. The Company actively monitors unauthorized use of its intellectual property and will take all available legal measures to enforce its rights. Any feedback, suggestions, ideas, or other communications submitted by the User to the Company regarding the Website may be used by the Company without restriction and without any obligation to compensate the submitting User. Third-party trademarks and intellectual property referenced on the Website remain the property of their respective owners, and no endorsement or affiliation is implied.

Legal Limitations

To the maximum extent permitted by applicable law, in no event shall Horizonix Corp N.V., its directors, officers, employees, shareholders, agents, licensors, service providers, or affiliates be liable for any indirect, incidental, special, consequential, exemplary, punitive, or aggravated damages of any kind, including but not limited to loss of revenue, loss of profits, loss of business, loss of data, loss of goodwill, business interruption, or any other pecuniary or non-pecuniary loss, arising out of or in connection with: the use of or inability to use the Website or its Content; any unauthorized access to or alteration of the User's data or transmissions; any conduct or content of any third party on or through the Website; any errors, omissions, interruptions, defects, or delays in operation or transmission; or any other matter relating to the Website, even if the Company has been advised of the possibility of such damages. In jurisdictions where the exclusion or limitation of liability for incidental or consequential damages is not permitted, the Company's liability shall be limited to the maximum extent permitted by law. The User agrees to defend, indemnify, and hold harmless Horizonix Corp N.V. and its officers, directors, employees, agents, licensors, and service providers from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, and fees, including reasonable legal fees, arising out of or relating to the User's violation of this Agreement, misuse of the Website, infringement of any intellectual property or other rights of any person or entity, or any breach of applicable law or regulation. The aggregate liability of the Company to any User for any claims arising out of or relating to this Agreement or the use of the Website shall not exceed the greater of the amounts paid by the User to the Company in the twelve months preceding the claim, or one hundred United States dollars (USD 100.00), whichever is lesser. The limitations of liability set forth in this section shall apply regardless of the form of action, whether in contract,
